End User License Agreement

You acknowledge that this EULA is concluded between you and FYAW only, and not with Apple Inc. (“Apple”). FYAW, not Apple, is solely responsible for the Licensed Application and its content.

This EULA may not provide for usage rules for the Licensed Application that are less than those in the Apple Media Services Terms and Conditions as of the date you download the Licensed Application.

The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded product that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application.

The Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing, subject to Apple’s terms.

FYAW is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.

FYAW is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you.

To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of FYAW.

FYAW, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:

• product liability claims;
• any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and
• claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, FYAW will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Self-search only: Your face scan is linked to your account. FYAW searches only for you — the registered user. The App is technically and contractually bound to prevent searching for any other person.

Face images (transient processing):The photographs you take during the face scan are transmitted to FYAW’s servers solely to perform the search. They are processed in memory, never written to persistent storage, and are not retained after the search completes.

Search results: Results are transmitted directly to your device and stored locally only. FYAW does not retain, log, or have access to these results.

Consent: Use of the face scan feature requires your prior explicit consent. You may withdraw consent at any time by deleting your account from within the App.

One-time scan: The face scan is performed once per account and cannot be changed or repeated.

FYAW processes facial biometric data in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR), specifically:

• Legal basis: Explicit consent pursuant to Article 9(2)(a) GDPR is obtained before any biometric processing.
• Data minimization: Only the minimum data necessary for the search function is processed and retained.
• Right to erasure: You may delete your biometric profile and all associated data at any time within the App.
• Purpose limitation: Biometric data is used exclusively for the face search function you requested.

Age requirement: You must be at least 18 years old to use FYAW. By accepting this EULA, you confirm you are at least 18 years of age.

Permitted use: FYAW is designed exclusively to search for your own online presence. You agree to use the App solely to find where your own face appears on the internet.

Strict prohibition — other persons’ faces:Attempting to register or use another person’s face is the most serious violation of this EULA and our Terms of Service. It will result in immediate permanent account termination and may constitute a criminal offence under applicable privacy and surveillance laws. There are no exceptions.

The Licensed Application uses the following third-party services, each governed by their own terms:

• Firebase (Google LLC): Authentication and data storage. Firebase Terms of Service.
• Stripe, Inc.: Subscription payment processing. Stripe Services Agreement.
• Google Play Billing: In-app purchase processing on Android. Google Play Terms of Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FYAW SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION.

THE TOTAL LIABILITY OF FYAW FOR ALL CLAIMS ARISING FROM OR RELATED TO THIS EULA OR THE LICENSED APPLICATION SHALL NOT EXCEED FIFTY U.S. DOLLARS (USD $50.00).

Apple is not responsible for any claims you or any third party may have relating to the Licensed Application or your use of it.

This EULA is governed by the laws of the Republic of Moldova. You may also be entitled to mandatory consumer protection rights under the laws of your country of residence.
